The Caring Fuel Collective – Terms & Conditions

1. DEFINITIONS

In this Agreement the following terms shall have the following meanings:
“We/Us/Our” means The Caring Fuel Collective Ltd, a company registered in England and Wales #16519370, acting as a broker for the arrangement of domestic heating oil supply.
“You/Your/Customer” means the person or company placing the order for domestic heating oil for residential use.
“Supplier” means the third-party supplier engaged to deliver the oil.
“Products” means domestic heating oil (Kerosene 28) for residential heating purposes only.
“Order” means a confirmed purchase request made by You through our website or by phone.
“Delivery Date” means the estimated date on which the Supplier delivers the Products.
“Delivery Location” means the property address provided by You for delivery.
“Force Majeure” means events beyond reasonable control including severe weather, strikes, accidents, or government restrictions.

2. SCOPE OF SERVICE

We operate solely as a broker arranging delivery of domestic heating oil from trusted Suppliers. We do not own or operate delivery vehicles, nor do we hold product stock. By placing an Order, You agree that the supply and delivery of the Products shall be performed by the Supplier, subject to both these terms and the Supplier’s own terms and conditions.

2A. WHAT YOU ARE BUYING

The Products you purchase will be described on our website or in your order confirmation. Your order confirmation will set out the volume, type and price of heating oil purchased.

We may, without notice:
– Alter the specification of the Products to ensure they comply with applicable safety or statutory requirements; and/or
– Make minor modifications that do not materially affect performance.

The Products are for domestic heating oil (Kerosene 28) use only.

3. RESIDENTIAL USE ONLY

All Products supplied are for residential use only. Companies may pay for and place Orders, but the Products must not be used for commercial, industrial, or agricultural purposes.

4. ORDERS

Orders can be placed 24 hours a day, 7 days a week, 365 days a year on our website. Orders are confirmed by email. We will endeavour to arrange delivery within 14 days, and in the main a standard delivery time stands at 5 working days. Delivery times are estimates and not guaranteed..  Minimum order quantity is 500 litres

5. DELIVERY

5.1 The Supplier shall use reasonable endeavours to deliver the required Products as specified in each accepted Order to the Delivery Location on the Delivery Date. Delivery is completed once the Products are unloaded into the Customer’s tank (or collected if applicable).

5.2 A delivery ticket showing the date, type and quantity delivered (and any remaining balance in the case of instalments) will be provided with each delivery.

5.3 The Supplier is responsible for measuring the volume delivered in accordance with law and good industry practice. Such measurements will be treated as conclusive unless clear proof to the contrary is provided.

5.4 The Customer is responsible for ensuring:
– Their tank has sufficient capacity (ullage) for the delivery.
– Tanks and storage installations are safe, sound, and compliant with statutory and environmental standards.
– Safe access for the delivery vehicle and hose (whether over private or public roads).
– That tanks are correctly labelled and calibrated with accurate means of measurement.

5.5 If delivery cannot be completed because of unsafe tanks, inadequate access, or insufficient ullage, the Supplier may refuse delivery and the Customer may still be liable for costs incurred.

5.6 The Supplier will normally provide up to nine metres of hose for delivery. Any additional hose length must be agreed in advance and may incur extra charges.

5.7 The Customer accepts responsibility for any loss, leakage or contamination of the delivered Product once in their tank or installation, except where caused by Supplier negligence.

5.10 The Customer (and any representative present) must comply with all statutory health, safety and environmental requirements relating to the receipt and storage of the Products.

5.11 If the Customer fails to take delivery within seven Business Days of notice that the Order is ready, delivery will be deemed complete and storage charges may apply. The Supplier may also cancel the Order without liability.

6. ACCEPTANCE AND DEFECTIVE PRODUCTS

6.1 The Customer may reject Products that do not comply with quality standards, provided notice is given:
– Within three Business Days of delivery for defects visible on inspection; or
– Within five days of becoming aware of any other defect.

6.2 If no notice is given within these times, the Products will be deemed accepted.

6.3 If Products are validly rejected, the Customer may require the Supplier to:
– Repair or replace the Products; or
– Refund the price in full (upon return of the Products).

6.4 Once the Supplier has complied with this obligation, it shall have no further liability in respect of the rejected Products.

7. PRICES AND PAYMENT

Prices are confirmed at the time of Order. Payment is due at the time of Order. Prices include VAT where applicable. A small-load premium may apply for lower volume deliveries.  A surcharge of £150 will be added for a next day delivery.

8. CANCELLATION

8.1 You may cancel an Order at any time before it is scheduled for delivery with no charge.  To cancel your order please call 0208 263 2383 with your order number to hand, or email your order to [email protected] – orders are not deemed cancelled until confirmed via email reply.

8.2 If cancellation occurs after the delivery has been scheduled or if a tanker has already been dispatched, you may be charged reasonable costs to cover wasted journeys (for example, mileage charges).

8.3 Once the Products have been delivered into your tank, you cannot cancel or return them.

8.4 Your statutory rights remain unaffected.

You may cancel an Order before it is passed to the Supplier at no charge. Once delivery has been scheduled, cancellation may not be possible and costs may apply. Products already delivered cannot be returned.

9. LIABILITY

We act only as a broker. We are not liable for delays, delivery failures, or defects caused by the Supplier. We are not liable for losses caused by Customer’s tank, pipework, or site conditions. We shall not be liable for loss of profit, business, goodwill, or other indirect or consequential loss. Our total liability shall not exceed the value of the relevant Order.

10. FORCE MAJEURE

Neither we nor the Supplier shall be liable for delay or failure caused by events outside reasonable control, including but not limited to severe weather, strikes, accidents, or government restrictions.

11. DATA PROTECTION

We collect and share Customer details (including name, address, contact details, and delivery instructions) with the Supplier for the purposes of arranging delivery. We and the Supplier process such data in accordance with UK data protection laws.

12. SUPPLIERS

As part of our commitment to safe, reliable and sustainable service, we work only with trusted suppliers who are ISO 9001 registered and hold quality, safety and sustainability at the centre of their operations. Policies and processes are in place to maintain exceptional levels of service at all times.

Our suppliers are fully compliant with Health and Safety standards, HSE legislation and industry codes of practice. They also adhere to environmental management standards, with directors endorsing comprehensive HSE policies.  For example, have achieved ISO 14001, OHSAS 18001 and ISO 50001 certifications.

Working with suppliers that hold these values ensures that The Caring Fuel Collective can deliver safe, responsible and high-quality service to our customers.

13. GENERAL

These Terms constitute the entire agreement between You and Us in relation to brokering domestic heating oil delivery. They shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
